Terms of Service

Welcome to TheCamsClub (“we,” “us,” “our,” or “the Platform”). By creating an account, accessing, or using our website, services, or any features thereof (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and all applicable laws and regulations.

If you do not agree with any part of these Terms, you must not use our Services. Your continued use of the Platform constitutes acceptance of any updates or modifications.

You must be at least eighteen (18) years of age (or the age of majority in your jurisdiction) to use the Platform. By registering, you represent and warrant that you are at least 18 years old and legally capable of entering into a binding agreement.

All creators and performers must complete identity and age verification through our third-party provider, Didit, before they may stream, upload content, or receive compensation.

You agree to use the Platform lawfully and respectfully. You shall not:

• •Use the Platform for any illegal, harmful, fraudulent, or abusive purpose;
• •Harass, threaten, intimidate, or stalk any other user, creator, or staff member;
• •Impersonate another person or misrepresent your identity or affiliation;
• •Share another user's personal or private information without consent (“doxxing”);
• •Attempt to gain unauthorized access to any part of the Platform, its systems, or user data;
• •Use bots, scrapers, scripts, or automated tools to collect data or manipulate the Platform;
• •Circumvent, disable, or interfere with any security, payment, or access-control feature;
• •Upload, stream, or transmit any malware, spyware, or malicious code;
• •Engage in money laundering, fraudulent chargebacks, or payment manipulation.

Violations may result in immediate account suspension, forfeiture of balances, and referral to law enforcement where applicable.

If you apply for and are approved as a creator on TheCamsClub, you agree to the following additional terms:

4.1 Streaming Rules

• •You may only stream content that you own or have express permission to broadcast;
• •You must comply with all real-time chat moderation and platform guidelines;
• •You are solely responsible for the content you produce and the interactions in your stream room;
• •You must not record, redistribute, or rebroadcast another creator's stream without consent.

4.2 Prohibited Content

The following content is strictly prohibited on the Platform:

• •Any content involving minors (individuals under 18), including suggestive or non-explicit depictions;
• •Non-consensual sexual content, including deepfakes, “revenge porn,” or content published without the explicit consent of all depicted parties;
• •Content depicting bestiality, sexual violence, or real physical harm;
• •Content promoting or facilitating terrorism, hate speech, or the exploitation of any person;
• •Content that violates intellectual property rights, including copyrighted material you do not own or have license to use;
• •Illegal goods or services, including drugs, weapons, or counterfeit items;
• •Content that violates applicable local, state, national, or international law.

We reserve the right to remove any content, terminate any stream, and permanently ban any creator who violates these rules. Reports of prohibited content will be prioritized and addressed within 24 hours.

TheCamsClub is a platform for adult content creators. We maintain a strict zero-tolerance policy for:

• •Child Sexual Abuse Material (CSAM) — any such content will be reported to the National Center for Missing & Exploited Children (NCMEC) and law enforcement immediately;
• •Content involving individuals under 18 in any capacity within adult areas of the Platform;
• •Non-consensual content of any kind;
• •Content that depicts or promotes illegal activity.

All creators must maintain records demonstrating that all performers are 18 or older, in compliance with 18 U.S.C. § 2257 and 28 C.F.R. § 75. See our 2257 Compliance Statement.

TheCamsClub respects the intellectual property rights of others. All Platform branding, design, code, and original content are owned by TheCamsClub or its licensors and protected under applicable copyright, trademark, and other laws.

Creators retain ownership of the content they produce and stream on the Platform. By publishing content, you grant TheCamsClub a worldwide, non-exclusive, royalty-free license to host, display, and process your content for the purpose of operating the Platform.

DMCA / Takedown Notice

If you believe your copyrighted work has been used on the Platform without authorization, you may submit a takedown notice to:

Notices must include the identifying material, proof of ownership, your contact information, and a good-faith statement under penalty of perjury. We will process valid requests within 72 hours.

7.1 Sparks

“Sparks” are the Platform's virtual currency. Users purchase Sparks with real currency and may send them to creators as tips or gifts. Sparks have no cash value to the user and are non-refundable except where required by law.

7.2 Creator Payouts

Creators earn revenue from Sparks received. Payouts are calculated based on the Platform's then-current revenue share and are disbursed according to the payout schedule published in the creator dashboard. Minimum payout thresholds and processing fees may apply.

7.3 Chargebacks & Fraud

Fraudulent chargebacks or payment disputes may result in account suspension, forfeiture of Sparks, and collection action. We reserve the right to deduct disputed amounts from creator balances.

We reserve the right to suspend, restrict, or terminate any account at any time, with or without cause or notice, including for violations of these Terms, fraudulent activity, or legal requirements.

Upon termination, your right to use the Platform ceases immediately. You remain responsible for any outstanding obligations. Any balances associated with terminated accounts due to violations may be forfeited.

You may delete your account at any time through the account settings page. Deletion does not automatically remove content you have published; you must request content removal separately.

The Platform is provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, TheCamsClub, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of (or inability to use) the Platform.

You are solely responsible for your interactions with other users. We do not endorse or guarantee the accuracy of any user-generated content.

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which TheCamsClub is incorporated, without regard to conflict-of-law principles.

Any dispute arising from these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

All visual depictions of sexually explicit conduct (“content”) hosted, streamed, or otherwise made available through the Platform were produced prior to July 3, 1995, or depict only individuals who are at least 18 years of age at the time of creation. We may update these Terms at any time. Material changes will be notified via email or in-Platform notification at least 14 days before taking effect. Your continued use after the effective date constitutes acceptance of the revised Terms.
